Terms and Conditions

1. Definition

   
   

   The following words and expressions shall have the meaning ascribed to them below except where the context otherwise requires:

   
   

   1. “Client” means any person who engages the Company to provide the Services;

      
      

   2. “Company” means MyCar Premium Chauffeur Services Sdn. Bhd. (Company Number: 202301044912 (1538828-K)), a company incorporated in Malaysia under the Companies Act 2016 [Act 777];

      
      

   3. “Driver” means an individual assigned by the Company to carry out the Services for Client;

      
      

   4. “Driving" means the act of operating Client’s vehicle for purposes of providing the Services;

      
      

   5. "Inspection" means the inspection of Client’s vehicle as required by the Client to be carried out by the person licensed under the Road Transport Act 1987 [Act 333].

      
      

   6. "Service" means the maintenance or repair of the Client's vehicle, as requested by the Client, to be performed by an authorized, appointed, or designated service centre as directed by the Client.

      
      

   7. “Pick-Up” means the process where Driver collects Client’s vehicle from Pick-Up Location;

      
      

   8. “Pick-Up Location” means the location for purposes of Pick Up of Client’s vehicle as agreed between the parties;

      
      

   9. “Return Location” means the location for purposes of Return of Client’s vehicle as agreed between the parties;

      
      

   10. "Return" refers to the process by which the Driver delivers the Client’s vehicle back to the Pick-Up Location or any other location as mutually agreed upon; and

       
       

   11. "Services" refers to the range of services provided by the Company to the Client, including the Pick-Up, Driving, and Returning of the Client’s vehicle to the Pick-Up or Return Location for Inspection, servicing, repairing or any other services and any other location as mutually agreed between the Client and the Company.

2. Services

By engaging the services of the Company, the Client agree to the following terms and condition:

1. Accidents

   
   

   In the event of an accident occurring during the inspection process, the Client shall be responsible for making any necessary insurance claims for damages incurred. This includes damages to the vehicle being inspected, third-party vehicles, and any affected property. While the Company will take all reasonable precautions to prevent such incidents, it shall not be held liable for damages arising during the inspection process.

   
   

2. Breakdowns or Mechanical/Electronic Problems

   
   

   The Client shall bear full responsibility for any breakdowns, mechanical issues, or electronic malfunctions that occur while the vehicle is undergoing inspection. The Company shall not be liable for repair costs, consequential damages, or delays resulting from such incidents, unless directly caused by the Company's negligence.

   
   

3. Theft or illegal activities

   
   

   The Company will take all reasonable measures to safeguard the Client's vehicle and its contents during service. However, the Client acknowledges that the Company shall not be liable for theft or loss arising from circumstances beyond its reasonable control. Both parties agree to cooperate in investigating such incidents and reporting to relevant authorities if required

   
   

   The Client and the Company agree that the Client’s vehicle shall not be used for any illegal activities, including but not limited to smuggling, unauthorized modifications, or acts prohibited by law. If such activities are identified, the Company reserves the right to cease services immediately and report to relevant authorities. Additionally, the Company commits to ensuring its drivers are vetted, trained, and supervised to prevent illegal activities. Should misconduct occur, the Company will take immediate disciplinary action and cooperate with investigations.

   
   

4. Disaster or Act of God

   
   

   1. In the event of a disaster or act of God (e.g., natural disasters, fire, flood, earthquake) impacting the vehicle during the inspection process, the Client

      agrees that the Company shall not be held liable for any resulting damages or losses. The Client is advised to ensure adequate insurance coverage for such unforeseen circumstances.

      
      

   2. Any disputes or claims arising from accidents, breakdowns, or acts of God during the inspection process will not hold the Company liable. Any modifications to these terms must be agreed upon in writing by both parties..
